Acceptable Use and Anti-Spam Policy

This Acceptable Use and Anti-Spam Policy (the "Policy") governs how you may use Atlas for Real Estate (the "Service") operated by Agent Atlas ("Agent Atlas," "we," "us," or "our"). It is part of our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service. If you violate this Policy, we may suspend or terminate your access as described in the Terms of Service.

Because the Service can draft and, where you enable it, send communications on your behalf, this Policy matters. You are the licensed professional and the sender of record. You are responsible for everything sent through or with help from the Service.

You are responsible for ensuring that any marketing, listing content, or advertising created with the Service complies with applicable rules, including:

The Service is a drafting aid. It does not review your content for legal compliance, and you must review and correct anything before you publish or send it.

3. Email and anti-spam (CAN-SPAM)

When you use the Service to draft or send email, you are the sender and you are responsible for compliance with the CAN-SPAM Act and similar laws. You agree that every commercial message you send through the Service will:

You agree not to use the Service to send unsolicited bulk email, to email purchased or harvested lists, or to email anyone who has opted out or asked you to stop. You are responsible for maintaining your own suppression and unsubscribe records.

4. No SMS or calling; your own calls and texts (TCPA)

The Service communicates by email and in-app only. It does not send SMS or text messages and does not place phone calls on your behalf. If you separately call or text the people you manage in the Service (for example using contact details the Service surfaces to you), you are the caller or sender, and you are responsible for compliance with the Telephone Consumer Protection Act (TCPA) and similar laws, including:

You represent that you have a lawful basis and any required consent to contact the people you reach through the Service, and that the contact data you use (including data in your connected accounts) was obtained lawfully and may be used for the purpose you are using it. You must not use the Service to contact people who have not agreed to hear from you where the law requires their agreement.

6. Reviewing what the agents send

The Service can draft communications and, where you enable sending, can send them on your behalf. You are responsible for configuring the Service appropriately, for reviewing content before it goes out where you have chosen review, and for the consequences of any communication sent through or with help from the Service. We do not monitor or approve the content you send.

7. Reporting abuse

If you believe someone is using the Service in violation of this Policy, or you received a message you believe was sent in violation of this Policy, contact us at atlas@agent-atlas.co.

8. Enforcement

We may investigate suspected violations and may suspend or limit access, remove content, or terminate accounts as described in the Terms of Service. We may also report activity to law enforcement or regulators where appropriate. Our decision not to enforce a provision in one case does not waive our right to enforce it later.

9. Changes to this Policy

We may update this Policy from time to time. Material changes take effect on the date stated in the updated Policy, and your continued use of the Service means you accept the change.
